In providing assistance to rental households, one of the largest unmet needs for tenant advocacy stems from fines and fees that renters face that are either not authorized by their rental agreement or are excessive. These types of fees are commonly referred to as “Junk Fees” and include excessive late rent fees, escalating penalties that are not based on actual costs associated with remedying issues, penalties for not maintaining renters insurance, and bounced payment penalties.

In Wisconsin, Eviction filings remain an online public record even if the action is dismissed before the hearing date or at the hearing because the landlord does not appear. An eviction judgement may stay on CCAP for 20 or more years.

According to the most recent data from the U.S. Department of Housing and Urban Development, there are 88,450 rental units in Dane County. Of the 1,629 eviction filings in 2022, 1,429 (88%) were for nonpayment of rent, 56 (3%) were for remaining in the rental unit after the expiration date of the rental agreement (commonly referred to as “holding over”), and the remaining 144 (9%) filings were for other breeches of the rental agreement.
