The length of time between an eviction notice being taped to a tenant’s door to a sheriff removing them from their home can vary widely. To analyze how fast evictions move in Dane County, we looked at a random sample of 150 evictions from this year and broke the process down into three parts: the lease termination notice, eviction court, and outcome.

A landlord receiving a writ of restitution is among the worst outcomes for a tenant in eviction court, as it authorizes a sheriff deputy to forcefully remove the tenant and their possessions from their home. This destabilizing, traumatic, and harmful scenario is distressingly too common in Dane County: 471 households have had writs issued against them since 2023, accounting for roughly 13% of all evictions filed during this period.

This challenge can become even more insurmountable when part of your landlord’s eviction filing consists of junk fees or charges that are not your responsibility under the rental agreement. These fees make it even more difficult for tenants to obtain and maintain stable, affordable housing. Examples of such fees include nonrefundable deposits, convenience fees, punitive charges, court costs, or excessive late fees.
